Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and TenFour (DBA / legal entity TBD) ("we", "us", "TenFour") governing your access to and use of the TenFour mobile app, the website at 10four.app, and any related services (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms. If you don't agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract under applicable law to use TenFour. By using the Service you represent that you meet these requirements.

3. Your account

You're responsible for the accuracy of information you provide and for keeping your account secure. Don't share your account credentials. Tell us at support@10four.app if you suspect unauthorized access.

You can have only one account at a time. Creating multiple accounts to evade bans, fake activity, or harass other users is prohibited and grounds for permanent suspension.

We may suspend, ban, or terminate access at our discretion if we determine that you have violated these Terms. We will generally try to give you notice and an opportunity to appeal except in cases of urgent safety, legal, or platform-integrity concerns.

5. Hazard reports — important clarification

TenFour lets drivers report road conditions including:

These reports are intended as road condition and safety information, the same way CB radio chatter and apps like Waze inform drivers about what's ahead. They are not intended for, and must not be used for, the purpose of evading or obstructing law enforcement, avoiding lawful inspections, or engaging in unlawful conduct on the road.

Drivers are solely responsible for operating their vehicles in compliance with all applicable traffic laws, weight regulations, hours-of-service rules, and any inspection or stop ordered by law enforcement. TenFour does not endorse, encourage, or aid in unlawful evasion. We reserve the right to remove reports that, in our judgment, exceed the scope of road-condition information or that promote unlawful activity.

6. User-generated content

You retain ownership of the content you post on TenFour (messages, voice messages, hazard reports, place reviews, profile information). By posting, you grant TenFour a worldwide, non-exclusive, royalty-free license to host, display, distribute, and process that content as needed to operate the Service. This license exists only as long as the content is on the Service or as needed to operate it.

You are responsible for the content you post. Don't post anything you don't have the right to post.

7. Trip logs and detention claims

The Service includes tools for logging trips (mileage, GPS-stamped origin and destination, per-diem flags) and dock-detention timers. These tools are provided as a convenience to help drivers track their own work for personal records, tax filing, and detention-claim documentation.

TenFour is not a tax preparer, accountant, ELD provider, or legal advisor. We do not certify the accuracy of trip log entries for IRS, FMCSA, or any other regulatory purpose. Drivers are solely responsible for verifying their records before submission to any third party. The trip-log audit-substantiation fields included in the app are designed to align with common IRS recordkeeping practices but do not constitute tax advice.

DRAFT NOTE: this is the second important load-bearing clause. The trip log feature is among TenFour's strongest paid-tier candidates per the trucker-feature research. Wording it carefully now means we're not making warranties we can't keep.

8. Voice channels

Live voice channels are real-time conversations. TenFour does not record, store, or transcribe voice channel audio. The audio is processed in real time by LiveKit Cloud and is not retained on our servers.

Voice messages (asynchronous voice posts in chat) are stored as audio files alongside the chat history, on the same retention rules as text messages.

You're responsible for what you say in voice channels. If you're uncomfortable being heard or recorded by other participants, leave the channel.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

10. Limitation of liability

To the fullest extent permitted by law, TenFour and its officers, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Our total cumulative liability to you for all claims arising from your use of the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred US dollars (\$100).

11. Indemnification

You agree to defend, indemnify, and hold harmless TenFour and its team from any claim, demand, loss, or damages (including reasonable attorneys' fees) arising from your violation of these Terms, your use of the Service, or your User Content.

12. Termination

You can terminate your account at any time by emailing support@10four.app. We can terminate or suspend your access for any violation of these Terms, for harm caused to other users, or to comply with law.

Sections that by their nature should survive termination — including 6 (User-generated content), 9 (Disclaimers), 10 (Limitation of liability), 11 (Indemnification), 13 (Governing law), and 14 (Disputes) — survive any termination.

13. Governing law

These Terms are governed by the laws of TBD (Anthony — fill in your state of residence or business incorporation, e.g., "the State of Indiana", excluding conflict-of-laws principles).

14. Disputes

DRAFT NOTE: this is the section to think hardest about. Common choices:

Pick a path with a lawyer and rewrite this section. For the v1 published policy, the simplest and most defensible version is the informal-resolution-first clause, with court jurisdiction specified, and revisit arbitration later if needed.

15. Changes

We may update these Terms. Material changes will be announced in-app and the Last updated date will change. Continued use after the effective date constitutes acceptance.
